NSSCC Terms & Conditions

 

1. About These Terms

These Terms & Conditions (“Terms”) govern your relationship with North Shore Sporting Car Club Inc. (“NSSCC”, “we”, “us”, “The Club”).

By applying for or renewing membership, using our Member Portal or participating in our events, you agree to these Terms and any policies referenced here (including our Privacy Policy).

Applies to: NSSCC membership, the NSSCC Member Portal, NSSCC events and activities, and use of NSSCC’s websites and official communications channels.

2. Eligibility, Accounts & Membership

  • Eligibility: Membership is open to individuals who meet NSSCC criteria set by the Committee. 
  • Account security: Keep your login credentials confidential. You are responsible for activity on your account. Notify us immediately of any unauthorised use.
  • Membership term & fees: Membership runs for the period stated at sign‑up. Fees are payable in advance and are non‑refundable unless required by law or under our Refunds clause.
  • Membership status: NSSCC may suspend or cancel membership for breach of these Terms, Code of Conduct, or safety rules.

3. Code of Conduct

Members and participants must:

  • Act respectfully toward officials, volunteers, and other competitors;
  • Comply with event instructions, venue rules, Motorsport Australia regulations (where applicable), and all safety requirements;
  • Not engage in harassment, discrimination, abuse, or unsafe driving; and
  • Not bring NSSCC into disrepute in online or offline conduct linked to club activities.

NSSCC may take disciplinary action (including suspension or expulsion) for serious or repeated breaches.

4. Event Participation & Motorsport Australia

4.1 Event rules and licencing

  • Event rules: Events are subject to the relevant Supplementary Regulations, Motorsport Australia regulations, and any venue‑specific terms.
  • Licensing: Certain events require a valid Motorsport Australia licence and proof of identity/age.
  • Briefings & equipment: You must attend all mandatory briefings and use required safety equipment in good condition.
  • Officials’ discretion: NSSCC officials may refuse participation or exclude a participant for safety or rule breaches

4.2 Event Entries

All events will require you to complete an entry form, usually through a digital platform. You are responsible for:

  • Completing all required entries on the designated platform;
  • Ensuring your data is accurate;
  • Complying with the platform’s usage terms;
  • Accepting any Motorsport Australia–required disclaimers, waivers, or declarations.

Failure to complete required platform steps may render your entry invalid.

5. Risk Acknowledgement & Assumption of Risk

Motorsport and associated activities are inherently risky. To the fullest extent permitted by law, by participating in NSSCC events you:

  • Acknowledge you understand the nature and risks (including injury, property damage, or worse);
  • Confirm you are medically and physically fit to participate;
  • Agree to follow all instructions and safety requirements; and
  • Accept responsibility for your participation, your vehicle’s condition, and your equipment.

Nothing in these Terms excludes any non‑excludable rights you have under the Australian Consumer Law (ACL).

6. Vehicle Compliance & Insurance

  • Roadworthy & compliance: You are responsible for ensuring your vehicle is fit for purpose and complies with event and regulatory requirements.
  • Insurance: Unless expressly stated, personal, vehicle, and equipment insurance are your responsibility. NSSCC’s insurance (if any) may have strict limits and conditions—ask us for details before the event.

7. Payments, Pricing & Refunds

7.1 Payment Methods

NSSCC accepts the following payment methods for memberships, event entries, merchandise and other club transactions:

  • PayPal
  • Stripe
  • Square
  • Direct credit to NSSCC’s Westpac Bank account

Additional payment methods may be used in the future and/or used by our third-party providers.

By making a payment through any of these providers, you agree to their respective terms and conditions. These providers may process or store data outside Australia; refer to their individual privacy policies for details.

7.2 Fees & Pricing

  • All fees are listed in Australian Dollars (AUD) unless otherwise stated.
  • Prices may change at any time before payment is completed.
  • Event fees may include additional venue charges, Motorsport Australia levies, insurance components, or transaction fees depending on event requirements.

7.3 Refunds, Cancellations & Withdrawals

Refunds for events and competitions are governed by the National Competition Rules (NCR) of Motorsport Australia, derived from FIA guidelines. Accordingly:

Withdrawals by Participants

  • Refund entitlements depend on the applicable Motorsport Australia NCR for that event category.
  • If a Supplementary Regulation (Supp Reg) specifies additional or different refund conditions, those rules take priority.
  • Where permitted by NCR, NSSCC may offer:
    • A full refund,
    • A partial refund (less administration or unrecoverable costs), or
    • A transfer or credit to a future event (where allowed by the regulations).

Event Cancellation by NSSCC

  • If NSSCC cancels an event due to safety, weather, minimum entry numbers, venue issues, or regulatory requirements, refunds will be provided in accordance with the National Competition Rules and the event’s Supp Regs.
  • In most cases, participants will receive either a refund or a credit less unrecoverable expenses incurred by the club.

Australian Consumer Law (ACL)

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law, including guarantees relating to services provided with due care and skill.

8. Participants Under 18

All members and event participants under the age of 18 must comply with the Supplementary Regulations and/or Motorsport Australia National Competition Rules (NCRs). This includes requirements for parent or guardian consent, appropriate supervision where required, and acceptance of all relevant terms and conditions by a parent or guardian on their behalf.

9. Working with Children Check (WWCC)

Requirements relating to Working with Children Checks (WWCC) for Officials are governed by Motorsport Australia. Where applicable, Officials designated by Motorsport Australia as requiring a WWCC must hold a current and valid certification in accordance with those requirements.

10. User-Generated Content & Photography

  • Content you post: You grant NSSCC a non‑exclusive, royalty‑free licence to use, reproduce, and communicate any content you upload to the Portal or submit to us for club purposes (e.g., newsletters, social media, event promotion), subject to your moral rights and our Privacy Policy.
  • Event media: By entering a club event or venue, you consent to reasonable photography/filming and to NSSCC using your image and likeness for club purposes. Tell us in writing if you object; we’ll take reasonable steps to accommodate where practicable.

11. Intellectual Property

All club content (logos, event materials, website content, results formats, images produced by NSSCC) is owned by NSSCC or licensed to NSSCC. You may not copy, adapt, or distribute it without written consent, except for personal, non‑commercial use.

12. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and Australian Privacy Principles. See: NSSCC Privacy Policy

13. Third-Party Services

Our website, Member Portal and events may rely on third‑party platforms (e.g., payment gateways, ticketing, cloud hosting, analytics). We are not responsible for those providers’ acts or omissions. Your use of third-party services is subject to their terms and privacy policies.

14. Prohibited Conduct (Member Portal & Online)

You must not:

  • Attempt to access accounts or data that aren’t yours;
  • Upload malware or content that is unlawful, defamatory, or infringing;
  • Interfere with the security or proper functioning of the Member Portal, website or other online media.

We may suspend or remove access that breaches this clause.

15. Disclaimers & Liability

  • General: To the maximum extent permitted by law, NSSCC excludes all implied warranties and is not liable for indirect or consequential loss.
  • ACL: Where liability cannot be excluded under the ACL, our liability is limited, at our option, to re‑supply of services or the cost of re‑supplying the services.
  • Motorsport risk: Participation is at your own risk; you agree that NSSCC’s liability is limited as allowed by law and by any waivers you sign for individual events.

16. Indemnity

You indemnify NSSCC, its committee members, officials, and volunteers against claims, losses, or liabilities arising from your breach of these Terms, your negligence, or your misconduct during events—except to the extent caused by NSSCC’s negligence or wilful misconduct.

17. Suspension or Termination

We may suspend your Member Portal access or membership where you breach these Terms, event regulations, safety requirements, or the Code of Conduct. Fees are not refundable for suspensions/terminations arising from your breach unless required by law.

18. Changes to Terms

We may update these Terms from time to time. The updated version will apply from the stated effective date and will be posted on our website and Member Portal. Material changes will be communicated to members where practicable.

19. Notices

We may provide notices by email, Member Portal notifications, website postings, social media posts or post to your last known address. You are responsible for keeping your contact details current.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non‑exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.

21. Definitions

  • Member Portal: The NSSCC online portal for members’ administration, communications, and event management.
  • Event: Any activity, meeting, or motorsport event organised or sanctioned by NSSCC.
  • ACL: Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
